 There are no prerequisites to fulfil to apply for access to traditional knowledge associated to genetic resources.

  1. Filing of the authorization application via the CERFA form n° 15784*01 (https://www.formulaires.service-public.fr/gf/cerfa_15784.do)
  2. Examination of the completeness of the file by the competent national authority
  3. Transmission of the file by the competent national authority to the public legal entity responsible for organizing locally the consultation of the community or communities that hold traditional knowledge associated with genetic resources
  4. Organization of the consultation of the communities by this public legal entity (minimum period of two months for a non commercial utilisation and minimum period of four months for a commercial utilisation), which identifies the timeframe and sets the minutes of the consultation. 
  5. If the prior informed consent of the communities is obtained, negociation and signature of a benefit sharing contract take place between the user and the public legal entity expressing the agreement concluded by the parties during the consultation.
  6. Issuance of an authorization decision by the competent national authority that certifies the prior informed consent (PIC) and the establishment of mutually agreed terms (MAT) regarding benefit sharing

Without prejudice to the protection of confidential information, the competent national authority shall forward to the ABSCH the required information to obtain the status of internationally recognized certificate of compliance (IRCC).
