Decree-Law 122/2017

Decree-Law 122/2017 establishes measures for the implementation of Regulation (EU) 511/2014 at the national level.

In particular, some elements of Regulation (EU) 511/2014 are further specified, namely the identification of competent authorities (responsible for compliance checks) and the establishment of the applicable penalties, among others, to infringements of articles 4 and 7 of Regulation (EU) 511/2014. Together with EU legislation on ABS, Decree-Law 122/2017 implements the obligatory compliance measures of the Nagoya Protocol in Portugal.

Decree-Law 122/2017 reiterates some elements of Regulation (EU) 511/2014 and Implementing Regulation (EU) 2015/1866 and it does not establish access rules at national level.
