HG&H Pharmaceuticals (Pty) Ltd may only use the Sceletium tortuosum for the purpose specified in the permit application documentation.

HG&H Pharmaceuticals (Pty) Ltd must submit progress report annually for the duration f the permit.

If new collaborators join the bioprospecting project for which the permit has been issued, HG&H Pharmaceuticals must notify the issuing authority in writing.

HG&H Pharmaceuticals (Pty) Ltd acknowledges the fundamental role played by traditional knowledge associated with Sceletium tortuosum as a departure point for new product discovery and innovation. This acknowledgement was formalized through a benefit-sharing agreement with the South African San Council and the Nama Community.


All money due to the South African San Council and the Nama Community in terms of a concluded benefit sharing agreement must be paid into the Bioprospecting Trust Fund, as required by section 85 (1) of the Act.

Conduct national and international research and development  on Sceletium tortuosum and associated traditional knowledge and commercialise the final product.

HG&H Pharmaceuticals (Pty) Ltd  will be liable for the costs of mitigating or remedying the impact of the bioprosecting on the environment, in accordnance with section 28 of the National Environmental Management Act, 1998 ( Act No. 107 of 1998)

HG&H Pharmaceuticals (Pty) Ltd must comply with all other legislative requirements for export outside the Republic of South Africa

HG&H Pharmaceuticals (Pty) Ltd may not transfer the materials of Sceletium tortuosum and associated traditional knowledge to any third party without a written consent  of the issuing authority.
