The Lao ABS Authority hereby acknowledges that Agroforex Company (Investment License No. 029-2020, dated 6 June 2020), represented by Mr. Francis Chagnaud (Director General; email: adriano.chagnaud@agroforex-company.com; Tel: +856 21 215665), is granted the right to access and utilize the benzoin tree. The ABS Authority further recognizes that the company conducts its activities in compliance with applicable laws and regulations of the Lao PDR and has obtained the necessary permissions for the purchase and export of raw materials to international markets. Such compliance includes, inter alia, adherence to relevant provisions under forestry legislation, trade and export regulations, and all required permits or approvals issued by competent national authorities, including permits for the harvesting and collection plans of forest products (Nos. 1065/MoAE, 1068/MoAE, and 1069/MoAE, dated 13 March 2026).

This permission is granted to Agroforex Company for a period of one year for the access and utilization of benzoin tree. Any request for extension shall be submitted to the Authority at least one month prior to the expiration of the permission. In accordance with the principles of access and benefit-sharing under the Nagoya Protocol, should scientifically research and development activities involving the genetic resources lead to the development and commercial production of any resulting product, Agroforex Company shall notify the ABS Authority for further consultation. Where such utilization falls within the scope of the Nagoya Protocol, the company shall, as appropriate, enter into mutually agreed terms with the competent national authority to ensure the fair and equitable sharing of benefits arising from such utilization, in compliance with applicable laws and regulations of the Lao PDR.

The company is currently engaged in activities related to the sourcing and trade of benzoin products through contracted farmers, including the cultivation of trees and the collection of production under the granted permission and in coordination with the monitoring and oversight of the relevant industry and agriculture authorities. All such activities shall be conducted in compliance with applicable laws and regulations of the Lao PDR. Where the utilization of genetic resources falls within the scope of the Nagoya Protocol, relevant access and benefit-sharing requirements shall apply, including prior notification to the competent ABS authority and, as appropriate, consideration of the establishment of mutually agreed terms to ensure fair and equitable benefit-sharing.
In cases where activities evolve from research to commercialization, the company shall inform the ABS Authority, provide updates on research progress or relevant reports, and obtain prior approval before any commercialization of products falling within the scope of the Nagoya Protocol.
