Legal and administrative competence of the CNA is based on the current Nature Protection Act (Official Gazette No 80/2013), particularly provisions related to protection of genetic diversity and access and utilization of genetic resources of wild species (Articles 88-98).
Ministry of Environmental and Nature Protection is a competent national authority responsible for implementation of the Nagoya Protocol.
The Ministry issues permits for access to genetic resources of native wild species located in situ, taking into consideration that activity will not jeopardize the survival of ecosystems and disrupt the population of native wild species to the point of becoming endangered. As exceptions to the prohibited acts and for the purpose of scientific research and education only, the Ministry can issue permits for access to genetic resources of native wild species that are strictly protected under the Nature Protection Act under certain conditions. In any case, the Ministry establishes requirements to ensure proper distribution of benefits that will result from the utilization of genetic material and for that purpose has a mandate to negotiate and conclude contracts with potential users. In some cases, the Ministry also issues permits for access to genetic resources from some ex-situ collections. Legal persons that want to engage in the work of gene banks of wild species should request approval and obtain a permit from the Ministry.
From legal and natural persons, the Ministry as a Competent National Authority should receive any information on transfer of genetic material to third parties or any information in regards to the change of intent in the process of utilization of genetic material.
This Ministry will be one of the checkpoint pursuant to Article 17 of the Nagoya Protocol.
