Art. L. 412-18 (II) from the French Law on biodiversity (2016) transpose article 17 of Nagoya Protocol (monitoring of the utilisation of genetic ressources) and designates the following “monitoring” checkpoints : The Ministry of Research for all recipients research funding (Art. L412-18), where such research involves utilisation of genetic resources and traditional knowledge associated with genetic resources. They are requested to declare that they exercised due diligence under the EU ABS Regulation 511/2014. The template for this declaration is contained in the Commission Implementing Regulation (EU) 2015/1866 of 13 October 2015 (Annex II). French competent authorities designated for the implementation of the EU ABS Regulation 511/2014, are the French Ministry of environment and Ministry of Research. They gather due diligence declarations from all users. The National Institute of industrial property (INPI) – Patent Office and the National competent authority for the market approval are also monitoring checkpoints designated under the French Law on biodiversity. (Art. L412-18. According to Nagoya Protocol, the monitoring checkpoints collect or receive relevant information and transmit this information to the relevant national competent authority for compliance checking. If the information is not confidential, the competent national authorities transfer it to ABS Clearing House.

The French law on biodiversity (2016) regulates access to genetic resources (in situ and ex situ) for their utilisation as well as access to traditional knowledge associated with genetic resource (GR) (detailed at point 39 hereafter). The scope of application of the French Law on biodiversity is detailed in Art. L. 412-5. PIC is required under the French national law for the utilisation of genetic ressources and traditional knowledge associated with genetic ressources. Specific provisions in the French law for GR from domesticated and cultivated species, GR from crop wild relatives used for plant breeding, GR used for sylviculture, pathogens which presents high risks for human, animal and plant health and food safety. A list of exclusions is also contained in the law (Art. L. 412-5 II. and III.) The digital sequence information, notion which is not included in the definition of genetic ressource contained in the Convention on biological diversity, does not fall within the scope of Nagoya Protocol. On that basis EU ABS Regulation 511/2014 transposing within the EU and its Member states the compliance pillar of Nagoya Protocol (through the due diligence obligation) does not regulate issues concerning digital sequence information. The use of digital data obtained from gene sequencing frequently stored in publicly available databases are not covered by the scope of the EU ABS Regulation 511/2014. Therefore, French law on biodiversity (2016) does not cover digital sequence information as such. It covers situations where there is a "tangible" link to the genetic ressource (in situ and ex-situ collections).

L.412-4.3c of the French law on biodiversity n° 2016-1087 of August 8,2016 and the ABS Implementing Decree N°2017-848 of May 9, 2017 define the concept of benefit sharing. The benefits araising from the utilisation of a traditional knowledge associated with a genetic ressource have to be shared with the local communities. The standard contract foreseen by the Administrative Order of September 13, 2017 entered into force on 29th of September 2017 applies also to the utilisation and benefit sharing of traditional knowledge. For the utilization of traditional knowledge, a specific written procedure is detailed in the implementing Decree n° 2017-848 of May 9, 2017 (Art. R.412-28 to R.412-38) in order to ensure the approval of communities for the utilisation of their traditional knowledge. A legal entity is been created (“personne morale de droit public”) to support concerned communities in the procedure of access and the negotiation of the benefit sharing contract. The Decree n° 2017-848 of May 9, 2017 foresees also a provision (Art. R.412-32) where the practices of communities embodying traditional lifestyles have to be taken into consideration and the information provided has to be in the language or the dialect they understand. Therefore, in the French legislation, the involvement and approval of the holders of traditional knowledge associated to a genetic resource have to be obtained by the users prior to the utilisation of the traditional knowledge. Art. 412-14 of the French law foresees the obligation that the benefits araised from the utilisation of traditional knowledge are to be directly shared with the concerned communities holding the traditional knowledge.

Both the ABS Regulation (EU) 511/2014 and Implementing Regulation 1866/2015 are applicable to genetic resources and to traditional knowledge associated with the genetic resources. They transpose in the EU compliance obligations foreseen in art.16.1 of Nagoya Protocol and they also apply to France. In order to utilise a GR and/or a TK associated with a GR, the user is obliged to ensure the respect of the provider country legislation through a due diligence obligation. In case of non compliance, several steps are foreseen in the French legislation (2016), including sanctions. Art. L 415-3 of the biodiversity law foresees : 1) A formal notice to give the user a deadline to comply with the ABS provisions before applying sanctions 2) In case of non compliance: Administrative sanctions (withdrawal of the permit) Criminal sanctions effective and proportionate to the circumstances of the situation (a fine of 150 000 € - 1 year imprisonment) Depending on the circumstances, the judge can decide on the application of a fine up to 1 million € in case of commercialisation without benefit sharing (illegal utilisation) and can prohibit the access to GR and/or TK during 5 years.

In case of non compliance with contractual obligations, enforcement of contracts is possible through the French jurisdictions. All depends on the law of the contract. Arbitration is also a possibility but as this is a distinct procedure from the common law procedure it depends on the choice made by Parties to the contract.

The Regulation also recognises that where Parties to the Protocol have decided to use the standard material transfer agreement for plant genetic resources for food and agriculture which are not covered by ITPGRFA, but which are under their control and management and in public domain, submission of due diligence declarations is not required. French law on biodiversity (2016) foresees specific provisions for access to certain genetic resources for food and agriculture (listed in Art. L 412-5 III) as explained at point 11 that are to be implemented by the Ministry of agriculture in compliance with France obligations under other international treaties.

At this stage it is too early to assess the contribution of Nagoya Protocol in France. However, as mentioned at point 45 above, there is a binding obligation in the French law, to use the benefits generated for the conservation and sustainable use of biodiversity. The ABS system is conceived in France as a tool aiming to the financing of projects for the conservation and sustainable use of biodiversity. The monetary benefits are to be managed by the French Biodiversity Agency that will be in charge of their implementation. The benefits araising from the utilisation of traditional knowledge are to be directed towards local communities and managed at the level of the communities.
