The Federal Office for the Environment FOEN will act as a centralized checkpoint according to Article 17 of the Nagoya Protocol. Those utilizing genetic resources or directly benefiting from their utilization (users) must notify compliance with the due diligence requirement to FOEN before market authorization has been obtained or, if such authorization is not required, before the commercialization of products developed on the basis of utilized genetic resources (see ABSCH-MSR Records: Article 23o of the Nature and Cultural Heritage Conservation Act). The responsibility of this centralized checkpoint will further be publish certain information of the notification and to forward information the provider country or to the ABS-CH, as appropriate.
