Act on the Implementation of the Nagoya Protocol to the Convention on Biological Diversity

The Finnish Parliament has adopted an implementing Act on 1 March 2016, establishing the required institutional structures. 
The Act implements certain provisions of the Nagoya Protocol on Access to Genetic Resources and the Fair and Equitable Sharing of Benefits Arising from their Utilization to the Convention on Biological Diversity, done at Nagoya on 29 October 2010 (Treaty Series of the Statutes of Finland 78/1994) (Nagoya Protocol). The Act also implements certain provisions of the Regulation (EU) No 511/2014 of the European Parliament and of the Council on compliance measures for users from the Nagoya Protocol on Access to Genetic Resources and the Fair and Equitable Sharing of Benefits Arising from their Utilization in the Union (EU Genetic Resources Regulation).

Section 5 of the adopted act includes a provision concerning the obligation of the user to report on the import of genetic resources or relating traditional knowledge to the competent authority within one month.
Section 6 According to Section 6 of the adopted act the [Sami Parliament] governs a database where the Sami traditional knowledge concerning genetic resources meant for research and development can be recorded.
Section 7 provides for the possibility to gain access to the information recorded in the abovementioned database.
Section 8 includes a general prohibition to impair the rights of the Sami people.
Section 10 of the act includes a provision concerning the national focal point. According to the provision, the national focal point is the Finnish Environment Institute.
In Section 11 two competent authorities have been provided for. The competent authorities are the Finnish Environment Institute and the Natural Resources Institute Finland. The competent authorities are also checkpoints under the Nagoya Protocol.
