  • ABSCH-MSR-BY-201806-6 Legislative, Administrative or Policy Measure Decree of the President of the Republic of Belarus "On Accession of the Republic of Belarus to the International Treaty"
    Decree of the President of the Republic of Belarus of 22 May 2014, No.235 "On Accession of the Republic of Belarus to the International Treaty". 
    The Decree prescribes:
     1. To accede to the Nagoya Protocol on Access to Genetic Resources and the Fair and Equitable Sharing of Benefits Arising from their Utilization to the Convention on Biological Diversity adopted in Nagoya on October 29, 2010. To designate the Ministry of Natural Resources and Environmental Protection responsible for fulfilling the obligations undertaken by the Republic of Belarus under the stated international treaty. 
    2. The Council of Ministers of the Republic of Belarus shall take the necessary measures to implement this Decree within six months. 
    3. This Decree shall enter into force on the day of its signing.

    the Council of Ministers of the Republic of Belarus: 
    1. Approved: 
    The Provision for monitoring in the field of genetic resources management and its data use; 
    The Provision for the disbursement of funds incoming during the distribution of monetary benefits. 
    2. Established a list of plant genetic resources for food and agriculture in accordance with the Annex. 
    3. Designated the National Coordination Centre on Access to Genetic Resources and Benefit-Sharing of the State Scientific Institution “Institute of Genetics and Cytology of the National Academy of Sciences of Belarus” as the Checkpoint for monitoring in the field of genetic resources management in the territory of the Republic of Belarus. 
    4. Declare the Resolution of the Council of Ministers of the Republic of Belarus of October 1, 2014, No. 933 “On the Establishment of the National Coordination Centre on Access to Genetic Resources and Benefit-sharing” to be no longer in force.

    The Resolution approves the Provision on the procedure for providing (changing terms of) access to genetic resources; provides information on documents to be submitted by the GRs and/or associated TK provider/user, an example of an application form to be submitted for GRs and/or associated TK transfer.
  • ABSCH-MSR-BY-267025-2 Legislative, Administrative or Policy Measure Law of the Republic of Belarus "On Genetic Resources Management"
    This Law was enacted in furtherance of the Nagoya Protocol on Access to Genetic Resources and the Fair and Equitable Sharing of Benefits Arising from Their Utilization to the Convention on Biological Diversity of October 29, 2010 (hereinafter referred to as “the Nagoya Protocol”), and it establishes legal bases for state regulation in the field of genetic resources management and/or associated traditional knowledge for the purpose of their protection and the fair and equitable sharing of benefits arising from their utilization to ensure the conservation and sustainable use of biological diversity, preservation of human health and provision of food security. 
Article 10 “Powers of the Ministry of Nature in the Field of Genetic Resources Management” of the Law of the Republic of Belarus “On Genetic Resources Management” establishes powers of the Ministry:
1. The Ministry of Nature is the competent national authority for access to genetic resources and benefit-sharing related issues.
2. In the field of genetic resources management, the Ministry of Nature shall:
2.1. Implement the unified state policy;
2.2. Fulfill, jointly with the National Coordination Centre, the coordination of activity and international cooperation;
2.3. Establish the forms of a Genetic Resources and/or Associated Traditional Knowledge Transfer Act (hereinafter referred to as “the Transfer Act”), a Genetic Resources and/or Associated Traditional Knowledge Transfer Notification and a Notification of Genetic Resources Utilization Results;
2.4. Administer the approval of the provision (a change in terms) of access to genetic resources;
2.5. Exercise other powers in accordance with this Law and other legislative acts.


Summary of ABS Responsibilities
Responsible for all genetic resources. Only designated competent national authority (CNA) for the country.
