Guyana developed a Policy on ABS in 2007. The full title of the document is the National Policy on Access to Genetic Resources and the Fair and Equitable Sharing of Benefits Arising from their Utilisation .
It is to be observed that the National Policy on Access to Genetic Resources and the Fair and Equitable Sharing of Benefits Arising from their Utilisation was developed prior to the text of the Nagoya Protocol. The Policy would therefore not have been developed with reference to the final text of the Nagoya Protocol.
From an administrative perspective there are research agreements which are concluded by both national and international researchers conducting research on genetic resources in Guyana.
Additionally, Guyana has prepared, and revised draft regulations regarding ABS. These drafts were prepared under the provisions of the Environmental Protection Act Cap. 20:05 of the Laws of Guyana.
The Environmental Protection Agency administers the permit and agreement framework for both local as well as international researchers.
Research in certain designated protected areas cannot be conducted without a permit. The permitting process is governed by the provisions of the Protected Areas Act No.14 of 2011 (Protected Areas Act).
A permit may be granted under the Protected Areas Act for non-invasive scientific research in a Strict Nature Reserve, a Wilderness Reserve, a National Park, on a Natural Monument and a Management Area for Habitat or Species. Additionally, permits for scientific research may be granted for scientific research in a Protected Landscape or Seascape as well as a Managed Resource Protected Area.
Several provisions of the Revised National Forest Policy Statement 2018 refer to research on forest biological diversity. Measures identified under Specific Objective 4 - Building Human and Institutional Capacity for Management include “(c) Promoting targeted research in forest and biodiversity issues and supporting the publication and dissemination of results to increase awareness. (e) Establishing a forest and biodiversity research funds which local agencies, academic institutions, civil society, and indigenous communities can access. (h) Supporting the development of infrastructure for watershed, eco-tourism and biodiversity research.”
Under the Forests Act No.6 of 2009 (Forests Act) use permits regulate the conduct of scientific research in state forests.
Research regarding wildlife biological diversity isgoverned by the provisions of the Wildlife Conservation and Management Act No.14 of 2016 (Wildlife Conservation and Management Act). Included in the specific functions of the Wildlife Conservation and Management Commission is the promotion of scientific research and knowledge of wildlife, within their natural habitats and for ex situ conservation management.
The Iwokrama International Centre for Rain Forest Conservation and Development Cap.20:04 makes provision for the sharing of the benefits of activities conducted in the area covered by the programme.
