Kenya Wildlife Service
It is a state corporation that was established by an Act of Parliament (Cap 376), now repealed by WCMA (2013), with the mandate to conserve and manage wildlife in Kenya, and to enforce related laws and regulations.KWS undertakes conservation and management of wildlife resources across all protected areas systems in collaboration with stakeholders.
The mandate of KWS is to:
Conduct and co-ordinate, all research activities in the field of wildlife conservation and management and ensure application of research findings in conservation planning, implementation and decision making;
Develop mechanisms for benefit sharing with communities living in wildlife areas;Identify user rights and advise the cabinet secretary thereon;Grant permits;Establish forensic laboratories.
The main role under the Nagoya protocol is to Management of wildlife genetic resources, and issuance of PIC, MAT and export permit
Wildlife Conservation and Management Act, 2013 provides for application for certain permits (in form of PIC) prior to access.
monitoring role involves obligations of user and provider in MAT, MTA and wildlife export permit

Wildlife Conservation and Management Act, 2013
The entire Act, including sections 10,
Section 22(2) Any person desirous of undertaking bioprospecting involving any wildlife resources may apply to the Authority for a permit in a prescribed format and on payment of prescribed fees.
(3) The Authority shall in reviewing the application ensure that any interests of the following stakeholders may have in the proposed bio-prospecting are protected-
(a) a person, including a public or private organization or institution or community,
providing or giving access to the wildlife resource to which application relates;
(b) a community- (i) whose traditional uses of the wildlife resources to which the application relates have initiated or will contribute to or form part of the proposed bio-prospecting; and (ii) whose knowledge of or discoveries about the wildlife resource to which the application relates are to be used for the proposed bioprospecting.
Section 72. (1) Utilisation and exploitation of wildlife resources by any person whether individual land owner or in a conservation area, and wherever else shall be practiced in a manner that is sustainable and in accordance with regulations made under this Act.
